Franklin man given two years for violating probation

A Franklin man who ran from police while trying to evade a warrant was sentenced to about two years in prison after the incident triggered a violation of the terms of his sentencing for a separate crime.

Robert Daniel Wood, 26, 3090 N. Morton St., was recently sentenced by Johnson County Superior Court 2 Judge Peter Nugent to 746 days of prison as part of a violation of probation. The violation occurred during a November incident where SWAT team members had to be called to get Wood out of a home.

Wood was on probation for previous charges which include battery on a public safety officer and strangulation, according to online court documents.

Wood pleaded guilty to the misdemeanor charge of resisting law enforcement and the probation violation. Wood and the prosecutor’s office agreed that any sentence for the misdemeanor charge would run consecutive to the violation sentence, Johnson County Prosecutor Joe Villanueva said.

Nugent sentenced Wood to 86 days on the misdemeanor charge. He then sentenced Wood to 746 days in prison for the violation of probation because of that new misdemeanor charge, Villanueva said.

In November, a man told a Franklin police officer that Wood had an active warrant. The officer found a felony warrant from Johnson County for battery of an officer and domestic battery. The officer drove to 3090 N. Morton St., Lot 21, where Wood was living with a relative, according to the report.

The officer talked to the relative, who said no one was in the home, although she told them coming in the home would not be a good idea. The officer saw one of Wood’s friends in the home, who denied knowing where Wood was, the report said.

The officer heard movement in a bedroom, but the relative continued to deny Wood was there. The relative said if someone had broken in, it was OK and the officer didn’t need to investigate. The relative answered her phone and appeared to be talking to Wood. She said, “Bobby, you need to give yourself up or I could get them to go to my bedroom so you can try to sneak out,” according to the report.

The police called the SWAT team after Wood refused to open the bedroom door. SWAT surrounded the home as the police suspected Wood was trying to escape through a crawl space. SWAT officers used a can of tear gas and captured Wood as he tried to escape through a window, the report said.
