Police: Man resisted arrest, exposed himself

Franklin police arrested an Indianapolis man they say resisted arrest, battered an officer and exposed himself.

Gregory Darnal Dewayne McCurtis, 24, was arrested on charges of battery on a law enforcement officer — a Level 5 Felony — resisting law enforcement resulting in injury, intimidation on law enforcement, public nudity, dealing marijuana, possession of marijuana, giving a false identifying statement, disorderly conduct and invasion of privacy.

Franklin police responded to a report that a man was trying to sell marijuana in the parking lot of a business in the 1100 block of North Main St., at about 1:30 p.m. Sunday.

Police arrived at the business and a manager told them McCurtis was smoking marijuana and trying to sell some to people outside the building, according to a Franklin Police Department report.

One officer went inside to review security footage, and another went to McCurtis, who was inside the building. The officer reviewing footage was soon called back to the main lobby because McCurtis had taken off his sweatpants and threw them at the employee behind the counter. The officer took the sweatpants from the employee and found McCurtis’s ID and a bag of marijuana in them, according to the report.

McCurtis, who was outside with the other officer, told police he was not Gregory McCurtis, despite what his ID said, the report said.

McCurtis argued and became agitated with the officers. At one point, he stood up and took a step toward one of them. In that moment, officers pinned McCurtis against a wall and tried to place him in handcuffs. He resisted with his hands behind his back. Officers took him to the ground and eventually put handcuffs on him, according to the report.

McCurtis refused to get inside the cop car, so officers called for a jail transport van. Officers told him to sit on the ground while they waited for a van, but he refused, saying the pavement was too hot, the report said.

At one point, McCurtis asked the officers if they thought they were stronger than him and said he was willing to get tasered. Officers asked why they would taser him, and McCurtis threatened them, according to the report.

Police informed him it was a felony to threaten an officer.

The jail van arrived, and McCurtis resisted walking to it, so officers had to drag him to the back of the van. He yelled about racism, said he wasn’t going to jail and resisted getting in the van. He sat on the back of the van with the doors open, the report said.

McCurtis then pulled up his shorts to expose himself. Officers told him not to do that, and he pulled his shorts back down, according to the report.

Officers forcefully put him into the back of the jail van. Once he was in the back, he kicked at officers and the van’s metal door. Officers had to force the door closed because McCurtis kept kicking it. His kicking, at one point, caused the door to strike an officer, cutting the officer’s hand, the report said.

McCurtis was taken to the Johnson County jail where he is held without bond due to an out-of-county warrant. He has a lengthy criminal history, and has been convicted of criminal recklessness, theft, burglary and drug possession in Marion County, according to online court records.
