Franklin man gets three years for battery against officers

A Franklin man who injured two police officers during a foot chase last year was sentenced to up to 3 years in prison.

Cody Allen Henry Davis, 26, pleaded guilty in Johnson County Superior Court 2 to two Level 5 felony charges of battery against a law enforcement officer, and a misdemeanor charge of criminal mischief. A misdemeanor charge of public intoxication was dropped, per the agreement.

For the Level 5 charges, Davis was sentenced to 1,825 days, with 730 days suspended, and 1,095 to be executed. He was sentenced to 90 days for the misdemeanor charge, with the sentence to be served concurrently, according to online court records.

On April 6, 2021, Franklin police were called to the area near U.S. 31 and Main Street after a man, later identified as Davis, crossed U.S. 31 and ran into a car that was stopped at a red light, according to the police report.

Officers asked Davis to stop and speak with them, but he ran away on foot. Davis ran to the 1900 block of Lochry Road, according to the report.

When police arrived, they found Davis yelling at a woman to call the police. Police asked Davis to stop yelling because they were already there, the report says.

Davis continued yelling and started jumping on a trampoline in the woman’s yard. Officers tried to calm him down for about three minutes, then surrounded the trampoline, according to the report.

Officers asked Davis to lie down but he ignored them, prompting one officer to climb on the trampoline with him. While on the trampoline, the officer discharged his taser and Davis jumped off. Three officers gathered around where Davis landed and tried to calm him down. Davis continued to struggle and punched an officer in the face, and kicked another in the face, the report says.

Both officers were treated for minor abrasions.
