Greenwood man charged with sexual battery

A Greenwood man is facing a sex crime charge after he performed a sexual act on someone who was sleeping.

Beau Thomas, 33, was charged with sexual battery, a Level 6 felony, in Johnson County Circuit Court on June 22. He was arrested on a warrant Tuesday.

Greenwood police responded to a report of sexual assault at an apartment on May 14. When police arrived, they spoke with a witness who said the incident had occurred the evening of May 13, when Thomas and his spouse were at the apartment with the witness and the victim, according to a probable cause affidavit.

The witness told police that Thomas, his spouse and them were spending time together in the apartment and that they were drinking. Thomas’s spouse had left prior to the incident, however, Thomas had planned to stay the night. The witness was alerted to an altercation between Thomas and the victim when they heard screaming and yelling overnight, the affidavit says.

The alleged victim told police they had come home late and had fallen asleep in the living room when they were woken up by Thomas performing a sexual act on them while they were asleep, according to the affidavit.

They did not give consent for Thomas to perform sexual acts, and once they realized this was happening, they began hitting Thomas. At one point they retrieved a firearm, but did not point it at Thomas or use it, the affidavit says.

Eventually, Thomas fled the apartment without his clothes and belongings, and the victim called the police.

A short while later, officers were notified that an Indiana State Police trooper had located Thomas near the intersection of Fairview Drive and Carney Drive. Thomas, who was only in his underwear, was running through several yards heading eastbound before he was stopped by police, according to the affidavit.

When officers spoke with Thomas, he said that he had blacked out from drinking too much and that the last thing he clearly remembered was sitting on the patio of the apartment drinking at around 1:30 a.m. He also said that he was then beat up inside the living room of the apartment and that he was unable to identify, nor provide a description of, the person who assaulted him. Thomas then ran out of the apartment to head to a nearby friend’s place, he told police.

Thomas was checked out by medical personnel and declined further treatment. His belongings were then returned to him and he was trespassed from the apartment, barring him from returning, the affidavit says.

A warrant for Thomas’ arrest was issued on Tuesday, and he was booked into the jail the same day on a $300 bond. He paid the bond and was later released.

An initial hearing has not yet been set.
