Indy man accused of raping teen at Bargersville party

An Indianapolis man is accused of sexually assaulting a teen at a September party in Bargersville.

Jaxon Scott Smith, 18, is charged with two counts of rape as a Level 3 felony. He was booked into the Johnson County jail on an arrest warrant Monday afternoon.

Bargersville police were dispatched to an Indianapolis hospital on Sept. 25 after receiving a call about a possible rape of a 15-year-old that took place in Bargersville. When detectives arrived, they spoke with the teen’s family, who said the teen had been raped by an 18-year-old, according to a probable cause affidavit filed on Nov. 28 in Johnson County Circuit Court.

The teen later told a child advocacy interviewer they were at a party after the Center Grove Homecoming dance on Sept. 25, according to the affidavit.

Someone had provided alcohol for the party, and the teen said they began drinking around 10 p.m. that evening. The teen drank for 30 minutes before throwing up in a bathroom and falling asleep, the affidavit says.

When the teen woke up, Smith was allegedly on top of them. They asked Smith to stop, and he allegedly did not and first, but eventually allegedly did stop, the affidavit says.

The teen also believed Smith removed their clothes, as they had pants on before falling asleep, according to the affidavit.

The teen told the interviewer Smith made several more advances over the course of the night and he was repeatedly told to stop, the affidavit says.

The next day, Smith was allegedly bragging about having sexual intercourse with the teen three times. Smith also allegedly tried to kiss the teen, according to the affidavit.

The teen also told the interviewer that they knew they had been raped because their genitals hurt.

When the teen was picked up by a relative later that day, they told the relative about what happened. They reported the incident and a sexual assault exam was then conducted by Bargersville Police, according to the affidavit.

Detectives spoke with Smith at his home in Indianapolis, and he allegedly said he tried to have sexual intercourse with the teen, but it “didn’t work.” He also claimed the sex was consensual, according to the affidavit.

When asked about why anyone would suspect him of sexual assault, Smith said he had a previous sexual assault allegation that everyone knew about. He also allegedly said the teen was warned not to be around him “because of his reputation,” the affidavit says.

DNA swabs of Smith were taken after the interview, the affidavit shows.

Smith remains at the Johnson County jail on a $32,000 bond. An initial hearing has not been set.
