Police: man intoxicated with children in vehicle

An Indianapolis man was arrested after police said he was intoxicated with six children in the vehicle.

Timothy Berry, 38, was arrested on a charge of operating a vehicle while intoxicated.

An officer driving east on County Line Road around 12:10 a.m. Sunday saw a vehicle driving in circles in an empty gravel parking lot, a Johnson County Sheriff’s Office report said.

Berry, who was driving, told a deputy that he had entered the parking lot so that he could turn around, the report said.

Six children were in the vehicle with Berry, whose ages ranged from 10 to 14, according to the report.

A initial test showed that Berry’s blood-alcohol content was .23 percent, nearly three times the legal limit to be considered too intoxicated to drive. Berry was taken to Johnson Memorial Hospital for a blood test, and those results are pending, the report said.

Berry, 7065 E. Payen Road, was arrested and taken to the Johnson County jail. He was held on $1,200 bond.
